The belief in miracle, as a modality of spiritual/religious coping strategy in the face of stress and psychic suffering, has been discussed in psychological literature with regard to its positive or negative role on the health and well-being of patients and family members. In contemporary times, where pseudo-conflicts between religion and science should have been long overcome, there is still some tendency of interpreting belief in miracle – as the possibility of a cure granted by divine intervention, modifying the normal (...) course of events in a bleak medical diagnosis – as having unhealthy impacts in the care and treatment of health. This position seeks to find a base in the three characteristics of hoping in a miracle, frequently pointed out by psychological literature: it would imply a negation of reality instead of its confrontation; it would be a coping strategy focused on emotion instead of the problem; it would imply seeking to modify the supposed desire of God by extra-natural facts. In this study, we shall critically discuss this position and the dangers of its crystallization by the use of SRC scales in which the act of praying for a miracle is previously classified as a negative strategy. We revisit some tendencies in psychological literature about the subject, taking into consideration the various facets of miracle, sociocultural facts, elements of idiographic nature, and their profound outcomes in the lives of people especially in health contexts. We illustrate the dangers of a hasty generalization of the results of nomothetic studies about the role of belief in miracle with two examples of research in the Brazilian context: one carried out with pregnant women with fetal malformation and the other with family members caring for children and adolescents with cancer under chemotherapeutic treatment. In both studies, the results do not confirm the predominance of the negative aspects associated with the act of praying for a miracle, which we discuss and analyze in light of the phenomenological perspective. In this perspective, “pray for a miracle”, as experienced by patients and caregivers, can be recognized as an act of openness to life, bolstering hope, and the resignification of reality in the psyche. O ensino de filosofia para/com crianças: uma revisão sistemática da literatura Resumo: O presente estudo tem como objetivo identificar, na literatura existente, quais os estudos sobre filosofia para/com crianças que investigam sobre as experiências das crianças nessa prática. Por meio de uma Revisão Sistemática da Literatura (RSL), realizada em três etapas: planejamento, seleção e extração, em cinco bases de dados diferentes, encontramos trinta e três (33) pesquisas sobre o ensino de filosofia para crianças (Philosophy for Children), porém, apenas duas (2) (...) pesquisas que abordam especificamente sobre as experiências das crianças com o ensino de filosofia. Neste artigo é defendida a tese de que a noção aristotélica de perfeição silogística não é completamente arbitrária e reflete características lógicas, apesar de alguns aspectos não lógicos. Em consonância com a sugestão de alguns intérpretes de que a validade dos silogismos em primeira figura se fundamenta no dictum de omni et nullo, será apontado como essa fundamentação se desdobra em procedimentos dedutivos encontrados nos textos de Aristóteles. Tomando definições ou explicitações das proposições categóricas como parâmetro, a perfeição ou imperfeição (...) de um silogismo, independentemente das relações de prova que se adote entre as figuras silogísticas, não se mostra arbitrária. The last few years have seen the development of a new line of research around the relationship between digital platforms and activism. The influence of the internet and social media on the civic and political engagement of young people in particular has become clear. Digital platforms perform in this regard a set of functions crucial to activism in terms of communication, mobilization, and logistics. These are indispensable tools, especially to young people belonging to informal structures. Digital platforms have also been (...) shown to facilitate emotional and solidarity networks thus fostering a sense of community and a strengthening of collective identities. In this article we aim at examining this aspect based on in-depth interviews with young activists conducted in Portugal during a three-year project (2020–2022). We have concluded that, especially in certain activism contexts involving social groups of neglected or non-normative identities, digital platforms function as a crucial empowerment tool. These are linked to the emotional support for and recognition of the identities of these young people, incentivizing the creation of fields of political and social intervention. (shrink)

O artigo trata das reformas educacionais apresentadas pelos organismos internacionais às nações periféricas, na perspectiva de um diálogo histórico-filosófico sobre as crises da educação nesse período de globalização. Privilegia o estudo teórico-bibliográfico de caráter analítico-exploratório, orientando-se pelo horizonte metodológico do materialismo histórico-dialético. Tem por objetivo compreender as implicações das crises do capital nas reformas educacionais dos países periféricos. No campo da educação, conclui-se que essas reformas estão em sintonia com as medidas neoliberais que visam fomentar uma mão-de-obra flexível e precarizada (...) para o mercado de trabalho, ao mesmo tempo em que buscam manter o controle socioeconômico e ideológico da classe trabalhadora. In this paper, we intend to offer an interpretation about the explanation of the (relative) idea of pure substance in general on John Locke’s philosophy, from Thomas Reid’s notion of ‘natural suggestion’. To achieve this aim, after contextualizing Locke’s notion of pure substance in general and distinguishing it from the idea of particular substance (section 1), we explicit that Locke’s words about the source of the idea of the former in the mind (either empirical or rational) are ambiguous and inconclusive (...) (section 2). Then, we argue that the parallels between this idea and that of ‘relation’, as well as of ‘power’ do not assist in that answer, due to some problems we identify on them (section 3). Finally, we argue that the Reidian explanation for the source of the idea of ‘mind’, from the notion of ‘natural suggestion’ allows us to i) avoid those problems and ii) inasmuch as, according to this interpretation, the idea of pure substance in general would have an empirical source, Lockian empiricism would remain intact (section 4). O presente ensaio inspirado na semiologia barthesiana tem por objetivo tematizar alguns desafios implicados no gesto aparentemente extemporâneo de escutar a escrita materializada no curso foucaultiano A Hermenêutica do sujeito. Trata-se de um exercício especulativo que, situando a educação no contexto das artes de viver, aborda o interesse crescente nas aulas ministradas por Foucault dedicadas à genealogia do sujeito implicada nas técnicas de si. Nesse percurso, defendemos que a atenção à escuta da voz que vem da escrita dessas aulas interfere (...) diretamente na recepção crítica da ética do cuidado de si. No limite, o que se busca enfatizar é como o tema do cuidado de si emerge inseparável de um gesto pedagógico que resulta de um estado singular de enunciação do pensamento. For a pleasurable semiology of Hermeneutics of the Subject Abstract: The present essay, inspired by Barthesian semiology, aims to discuss some of the challenges involved in the apparently extemporaneous gesture of listening to the writing materialized in the Foucauldian course The Hermeneutics of the Subject. This is a speculative exercise that, placing education in the context of the arts of living, addresses the growing interest in the classes taught by Foucault dedicated to the genealogy of the subject implicated in the techniques of the self. In this course, we argue that attention to listening to the voice that comes from the writing of these classes interferes directly in the critical reception of the ethics of the care of the self. Population control through discriminatory practices is found at all times in history. Never before, however, has use of the sciences been so close to achieving the creation of new mechanisms for generating human "subspecies". This study, which is based on a selected theoretical framework, deals with the biotechnological and bioethical challenges on the path to manipulation as concerns the development of potentially harmful practices in a pluralist context. O discurso funcional é tanto ubíquo quanto central na ecologia contemporânea, principalmente no contexto das pesquisas sobre biodiversidade e funcionamento ecossistêmico, que emergiram nos anos 1990 em meio à crise da biodiversidade. Entretanto, a despeito dessa forte presença na ecologia, o discurso funcional ainda não tem sido investigado de maneira adequada nesta ciência, na medida em que muitos problemas fundamentais a respeito do tema ainda permanecem sem respostas claras. Por um lado, os ecólogos que lançam mão de explicações funcionais parecem (...) simplesmente tomar como dado ou autoevidente o conceito de função. Contudo, ele nada tem de trivial, tendo em vista os problemas filosóficos suscitados pela linguagem funcional ou teleológica nas explicações biológicas, pelo menos desde Aristóteles. Por outro lado, poucos filósofos da ciência têm se mostrado especialmente interessados nos problemas epistemológicos associados ao discurso funcional em ecologia. Tomando essa situação como ponto de partida, nossa abordagem neste artigo se dá em três etapas. Inicialmente, procedemos a uma análise conceitual de função na ecologia atual, com ênfase nos estudos que relacionam a biodiversidade às propriedades ecossistêmicas. Esboçamos três significados principais do conceito, mostrando os pressupostos e as implicações associados a cada um deles. Num segundo momento, procedemos a uma análise das razões que levam a suspeitas ou objeções contra a linguagem funcional na ecologia. Por fim, num terceiro momento, lançamos algumas sugestões sobre como fundamentar ou dar mais clareza ao discurso funcional na ecologia contemporânea. (shrink)

Repisando a trilha clássica de aproximação ao Direito, o livro repropõe o método realista para pensar o Direito. Um estar de novo do pensamento jurídico tradicional, com sua persistente atualidade, está a exigir que se retome e guarde a analogia do termo Direito e a conclusão de que, antes de mais, sendo o Direito uma coisa, a 'coisa justa', seus demais possíveis conceitos são somente analogados secundários que, por importantes se estimem, demandam sempre referência subalterna àquele prius significativo - antes (...) de tudo, o Direito é justo. Essa perspectiva realista reabre a esperança de que, mediando a experiência e a dialética, se reencontre e aprofunde uma teoria da justiça ancorada na natureza das coisas. Neste artigo apresenta-se a proposta de estudos humanísticos da informação, particularmente a partir das observações do filósofo holandês Harry Kunneman. Esse trabalho se inicia com a investigação e a discussão da noção hegemônica do que é Informação dentro da Ciência da Informação, vinculada a sua origem funcionalista. Nesta discussão cabe destacar na demarcação do conceito de informação a teoria matemática da comunicação e das teorias de sistemas. As limitações das abordagens funcionalistas da Informação tem como resposta a busca e o (...) desenvolvimento de teorias críticas. Discute a origem funcionalista do conceito de informação. Nas seções seguintes aborda os artigos de Kunneman, começando pelas perspectivas de uma abordagem humanista da Informação, com destaque aos modos de produção do conhecimento. O item a seguir trata sobre a profissionalização normativa visando o exercício das profissões privilegiando os valores humanísticos. A profissionalização normativa e seu caráter interdisciplinar se liga aos modos de produção do conhecimento. Conclui-se que há a necessidade de inserção dos conceitos abordados na pesquisa no dia a dia do profissional da informação, alinhando as preocupações éticas incorporadas às questões de vida. Researchers and other professionals unanimously agree that companies should become more sustainable, but this will not happen without the support of human resource management. Paradoxically, there is a lack of information on the support human resource management offers to organizational sustainability applied to real cases. Therefore, this research presents a case study on this topic that was carried out in a leading Brazilian company, which is considered as a model and has been selected as ‘the best place to work in (...) the country’. The results provide practical examples of how this family company has been working to guarantee an increasingly sustainable performance with the support of human resources, highlighting the achievements and challenges the company has faced. One of the main results indicates that companies seeking to achieve sustainability need the assistance of the human resource field in order to design a communication system which bridges the gap between practices and sustainable values. O artigo pretende analisar e sugerir uma saída para o paradoxo democrático, o dilema moral constitutivo entre a soberania nacional do Estado democrático liberal e o reconhecimento dos direitos humanos dos estrangeiros, apontado por Donatella Di Cesare. Para isso, serão reconstruídos o referido paradoxo, a partir das críticas da autora a Michael Walzer e David Miller, e a solução apontada por ela, que envolve a superação da ordem estadocêntrica e a criação de uma comunidade política que não seja centrada na (...) identidade nacional. Em seguida, serão sucessivamente analisadas as posições de tais autores, mostrando-se que as críticas feitas por Di Cesare não correspondem aos trabalhos desenvolvidos por eles sobre comunidade política e identidade nacional. Por fim, será sugerido que há congruências entre esses três autores que poderiam ajudar na construção conceitual de um conceito de comunidade política capaz de oferecer uma direção inicial de saída do paradoxo democrático. O desenvolvimento tecnológico promoveu o aumento de produção e compartilhamento de conteúdo em plataformas digitais, sendo difícil gerenciar o acesso adequado a informações. O presente artigo tem como objetivo discutir os efeitos do direito ao esquecimento no ambiente digital, considerando o processo de desindexação como estratégia para operacionalizar a efetividade desse direito. Tomando como referências arcabouços teóricos-conceituais acerca da complexidade compósita da informação e de antinomias entre a dignidade da pessoa humana e a liberdade de expressão e o direito à (...) informação, oriundos, respectivamente, da Ciência da Informação e do Direito, analisam-se e discutem-se algumas decisões jurisprudenciais e posicionamentos doutrinários no cenário brasileiro. O direito ao esquecimento está cercado de ambivalências e desafios de ordens normativa, tecnológica e cultural, num compartilhamento de informações em níveis sem precedentes que interferem negativamente na sua efetivação no ambiente digital. Introduction: The actions taken by the government to deal with the consequences of the coronavirus diseases 2019 pandemic caused different levels of restriction on the mobility of the population. The need to continue offering physical exercise to individuals after stroke became an emergency. However, these individuals may have barriers to adhere to the programs delivered remotely. There is a lack of evidence related to adherence, attendance, safety, and satisfaction of remote exercise programs for this population.Objective: The aim was to evaluate (...) adherence and barriers to attend a remote physical exercise program for individuals after stroke. We aimed to identify adherence and attendance rate of the remote physical exercise program ; to identify the safety of a remote physical exercise program ; and to identify the overall experience to participate in a remote program.Materials and methods: This is a longitudinal study, including 36 stroke survivors who already attended a face-to-face physical exercise program prior to the COVID-19 pandemic. The remote physical exercise program included sessions for 2 days/week for a duration of 22 weeks, with a total of 44 sessions, which were delivered asynchrony via recorded video sessions. As outcome measures, we performed two questionnaires to identify attendance, barriers, safety, and overall experience related to the program.Results: The adherence rate was 86. The attendance rate was 19, with a total of 8 sessions. The main barriers for lower attendance rate were as follows: lack of motor skills and physical fitness to workout in 80 reports, followed by no exercise companion in 44 reports. The remote physical program has been shown to be safe, and the overall experience was positive from the perspectives of the participants and the family members.Conclusion: Although the adherence rate was high, the attendance rate was low on the remote physical exercise program. The main barriers to attending the program remotely reflect the need of tailoring individually an asynchrony mode of delivering the sessions to individuals after stroke. Our results also indicate how the COVID-19 impacted the health conditions of stroke survivors. The program was safe, and the overall experience indicated a change in the mental, physical, and social health of individuals after stroke and their family members. (shrink)

In this article, we propose the social-ecological theory of maximization to explain the construction and functioning of these systems over time, encompassing hypotheses and evidence from previous ethnobiological studies. In proposing (...) the theory, we present definitions and two conceptual models, an environmental maximization model and a redundancy generation model. The first model seeks to address biota selection and its use by human populations. The second emphasizes how the system organizes itself from the elements that were incorporated into it. Furthermore, we provide the theoretical scenario of plant selection and use from an evolutionary perspective, which explicitly integrates the phylogenetic relationships of plants and human beings. A concretização do direito à saúde deve ser viabilizada pelo Estado, com foco na efetivação das políticas públicas para garantia da implantação e funcionamento dos serviços demandados pelos respectivos grupos populacionais. Destarte, essa escrita objetivou analisar como o direito à saúde é contemplado em comunidades quilombolas de uma região geográfica baiana. Metodologicamente enquadra-se como de abordagem qualitativa, com informações obtidas por meio de entrevistas estruturadas (sobre a infraestrutura e/ou serviços públicos de saúde) desenvolvidas com as representações das Associações de Moradores (...) de 14 quilombos da região geográfica de Guanambi/Bahia durante o ano de 2016. Os achados indicam que uma comunidade possuía estrutura física específica para atendimentos básicos em saúde, no entanto, estava desativada. Três comunidades não tinham cobertura do Programa de Agentes Comunitários de Saúde (PACS). Entre as 11 que indicaram cobertura do Programa, em sete as(os) profissionais não residiam no território do quilombo. Diante da ampla ausência de infraestrutura e recorrente inadequação na prestação de serviços do PACS, evidencia-se a permanente negligência ao direito à saúde nesta população quilombola. (shrink)

Introduction: The importance attached to ethical practice and related informed consent varies among health professionals and is further influenced by working environments, level of knowledge, experience and societal values and beliefs. The objective of this study is to evaluate the ethical conduct of professors, undergraduates and graduate students through questionnaires answered by patients. Methods: One hundred twenty patients at the dental clinics of three different dental schools in São Paulo State were interviewed based on objective and discursive questions about signed (...) informed consent, participation in scientific research, photographs during treatment, requested saliva samples, tooth donation requests, and information about tooth destination after removal. A frequency distribution was used for a statistical analysis of the data. Results: In all, 65.8% of the patients had given signed informed consent for treatment and 12.5% had not done so; 10.8% did not know if they had participated in scientific research; 54.2% were photographed during dental procedures and 47.1% of them had signed an authorization form; 6.6% were requested to provide a saliva sample and 66.6% of them had signed an authorization form to that effect; 16.1% had a tooth donation requested and 64.4% of them had signed an authorization form to that effect; and 61.3% did not know the destination of the tooth after removal, when donation was not requested. Conclusions: The majority of the patients had signed an informed consent form for treatment, photographs, saliva samples and tooth donation. O período escravocrata brasileiro deixou marcas profundas nas populações negras e quilombolas. Este sistema contribui para um cenário racista que fomenta injustiças sociais e em saúde. Nesse sentido, o presente texto objetiva investigar na literatura científica o acesso e a utilização dos serviços de saúde pela população negra e quilombola. A partir de uma revisão de literatura do tipo descritiva narrativa. A busca das publicações ocorreu na Biblioteca Virtual de Saúde e no Google Acadêmico. Foram selecionadas 39 publicações entre os (...) anos de 2016 e 2018 organizadas nas seguintes categorias: acesso e utilização dos serviços de saúde pela população negra e quilombola e suas principais morbidades; implicações geográficas e fatores influenciadores no acesso e utilização dos serviços de saúde. As análises indicam que o acesso e utilização dos serviços de saúde pelas populações negras e quilombolas brasileiras sofrem mais importantemente os efeitos nocivos dos marcadores sociais, espaciais, de gênero, de classe socioeconômica e principalmente quanto ao pertencimento étnico-racial. A dificuldade de acesso e utilização dos serviços de saúde pelas populações negras e quilombolas brasileiras repercute as iniquidades, resultando no agravamento de processos de adoecimentos de ordem crônica, como Diabetes e hipertensão, e problemas de qualidade assistencial, como no acompanhamento pré-natal. Brazil stands out at the global level for having implemented several policies intending to promote agroecology as a productive paradigm for small-holder farmers. However, the impacts of this process of institutionalization of agroecology still lack research and debates that evaluate the effectiveness of these policies. In this paper, we assess and discuss the impacts of a policy specifically focused on education in agroecology, the support to the establishment of Centers for the Study of Agroecology and Organic Production (NEAs) in more (...) than 150 higher education institutions throughout Brazil. NEAs bring together teachers, researchers, and students who engage in teaching, research, and extension activities in partnerships with peasant farmers, their organizations, and rural extension workers. The hypothesis that guides our analysis is that this support to establish NEAs allowed redistribution of symbolic power in the universities where they were established, supporting agroecology to gain greater legitimacy inside and outside the university field. Based on an in-depth study of four NEAs, performed through participant observation and documentary analysis, the NEAs are evaluated from the perspective of social fields in dispute, first in a university sphere, but also from the perspective of training people in integrative and transdisciplinary thinking that will contest the industrial-corporate food regime. Our findings suggest that the State support to university groups dedicated to the promotion of agroecology has allowed the construction of what we have named agroecological spaces, which symbolically dispute the dominant paradigms in educational institutions, supporting the constitution of material and immaterial agroecological territories. This is the report on the XVI BRAZILIAN LOGIC CONFERENCE (EBL 2011) held in Petrópolis, Rio de Janeiro, Brazil between May 9–13, 2011 published in The Bulletin of Symbolic Logic Volume 18, Number 1, March 2012. -/- The 16th Brazilian Logic Conference (EBL 2011) was held in Petro ́polis, from May 9th to 13th, 2011, at the Laboratório Nacional de Computação o Científica (LNCC). It was the sixteenth in a series of conferences that started in 1977 with the aim of (...) congregating logicians from Brazil and abroad, furthering interest in logic and its applications, stimulating cooperation, and contributing to the development of this branch of science. EBL 2011 included more than one-hundred and fifty participants, all of them belonging to prominent research institutes from Brazil and abroad, especially Latin America. RESUMO O objetivo do presente trabalho consiste em explicitar o itinerário ou linha argumentativa de Gilles Deleuze no artigo intitulado "A concepção da diferença em Bergson", de 1954. Postula-se que nesse trabalho de 1954, Deleuze exponha a noção de 'diferença', que está presente na obra de Henri Bergson, por meio da relação entre três dimensões: metodológica, cosmológica e ontológica. Para tanto, caracteriza-se o conjunto do pensamento de Deleuze em relação à História da Filosofia. Em seguida, identifica-se o percurso das pesquisas (...) de Deleuze sobre a obra de Bergson no contexto de sua versão para a História da Filosofia. Por fim, explicita-se o itinerário de Deleuze no artigo de 1954: "A concepção da diferença em Bergson". ABSTRACT The purpose of this paper is to explain the itinerary or argumentative line of Gilles Deleuze in the article named "The conception of difference in Bergson" of 1954. It is postulated that in this work of 1954, Deleuze exposes the notion of "difference", which is present in the work of Henri Bergson, through the relation between three dimensions: the methodological, cosmological and ontological ones. For that purpose, the whole of Deleuze's thought in relation to the History of Philosophy is characterized. Then, we identify the course of Deleuze's research on Bergson's work in the context of his version for the History of Philosophy. Finally, we explain the itinerary of Deleuze in the article of 1954: "The conception of difference in Bergson". (shrink)

Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. In this paper I present a formalization of the theory of ideal concepts applied to the concept of God. It is done within a version of the Simplest Quantified Modal Logic (SQML) and attempts to solve three meta-problems related to the concept of God: the unicity of extension problem, the homogeneity/heterogeneity problem and the problem of conceptual unity.

Em analogia com outras discriminações, como o racismo ou o sexismo, o especismo é concebido como uma forma de discriminação moral com base na espécie. Em grande medida, a discussão contemporânea sobre a importância moral dos animais surgiu e desenvolveu-se em torno da crítica e da defesa do especismo. Este artigo oferece uma visão da discussão filosófica contemporânea sobre o especismo. Após uma breve introdução, apresenta-se uma definição de especismo e caracterizam-se vários tipos de especismo, sendo o Antropocentrismo o mais (...) relevante. Depois, expõe-se um argumento proeminente contra o Antropocentrismo: o argumento dos casos marginais. Por fim, algumas posições antropocêntricas são criticamente discutidas. (shrink)

This paper suggests the democratic direction in which the right of freedom of expression should be conceived and applied. In the first two sections it suggests some counter-examples to, and diagnoses of, the libertarian and liberal conceptions of freedom of expression, taking Scanlon (1972) and Scanlon (1979), respectively, to be their chief proponents. The paper suggests that these conceptions cannot take into account clear examples, like fraudulent propaganda, which should not be legal. The democratic conception takes it to heart that (...) the pillars upon which the right of freedom of expression is founded are individual and collective autonomy, the right to know facts of public interest and information necessary for effective democratic control of government. The paper suggests that in a time when private powers seriously threaten these pillars, it is correct for the government to step in to provide the framework in which genuine discussion geared toward fulfilling the objectives of these pillars can take place. People sometimes explain behavior by appealing to an essentialist concept of the self, often referred to as the true self. Existing studies suggest that people tend to believe that the true self is morally virtuous; that is deep inside, every person is motivated to behave in morally good ways. Is this belief particular to individuals with optimistic beliefs or people from Western cultures, or does it reflect a widely held cognitive bias in how people understand the self? To address this (...) question, we tested the good true self theory against two potential boundary conditions that are known to elicit different beliefs about the self as a whole. Study 1 tested whether individual differences in misanthropy—the tendency to view humans negatively—predict beliefs about the good true self in an American sample. The results indicate a consistent belief in a good true self, even among individuals who have an explicitly pessimistic view of others. Study 2 compared true self-attributions across cultural groups, by comparing samples from an independent country and a diverse set of interdependent countries. Results indicated that the direction and magnitude of the effect are comparable across all groups we tested. The belief in a good true self appears robust across groups varying in cultural orientation or misanthropy, suggesting a consistent psychological tendency to view the true self as morally good. A growing body of research has examined how people judge the persistence of identity over time—that is, how they decide that a particular individual is the same entity from one time to the next. While a great deal of progress has been made in understanding the types of features that people typically consider when making such judgments, to date, existing work has not explored how these judgments may be shaped by normative considerations. The present studies demonstrate that normative beliefs do (...) appear to play an important role in people's beliefs about persistence. Specifically, people are more likely to judge that the identity of a given entity remains the same when its features improve than when its features deteriorate. Study 1 provides a basic demonstration of this effect. Study 2 shows that this effect is moderated by individual differences in normative beliefs. Study 3 examines the underlying mechanism, which is the belief that, in general, various entities are essentially good. Study 4 directly manipulates beliefs about essence to show that the positivity bias regarding essences is causally responsible for the effect. (shrink)

The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

In this essay, I focus on Lugones’s relatively lesser explored notion of playfulness. I weigh in on the debate about whether playfulness is necessary for what Lugones calls “world-traveling,” which enables one to recognize another person as a full subject. I argue that although the attribute of playfulness may not be necessary for world-traveling, it is necessary for collaborative world-making––creating a new, shared world that is opened through the activity of play.

For a long while the dilemma between ‘not being’ and ‘being other’ has haunted the history of Brazil. The country's mixed-race condition lay at the heart of the dilemma which reached its apogee in the second half of the nineteenth and the beginning of the twentieth centuries. At that point in its history, that is, its emergence as a nation-state, the construction of a national identity became an imperative for the political and intellectual elites of Brazil.
